Please read our Terms and Conditions of Use and Sale. Purchase implies agreement to these terms.

1. About these Terms and Conditions.

In these terms and conditions 'the Company' means GLOBAL MARKETING GROUP LIMITED and 'Customer' means the person placing the relevant Order. In these terms and conditions words spelt with initial capital letters are defined terms. These terms and conditions together with your Order constitute the contract between the Company and you for the supply of Products. No other terms and conditions shall apply. The contract can not be varied unless the Company agree to vary it in writing.

2. Prices

2.1 VAT is payable by the Customer at the applicable rate indicated on the Invoice.
2.2 Delivery costs are payable by the Customer as indicated on the Invoice.
2.3 The Company reserve the right to change prices without prior notice.

3. Delivery of Your Products

3.1 No responsibility is taken for breakages, shortages or errors unless the delivery document is endorsed accordingly, and we are notified in writing within three days of receipt. In the absence of such notification the customer will be deemed to have accepted the goods.
3.2 In the event of non-delivery or part delivery the Company shall be notified of the details within three days of the placement of the order.
3.3 The Company reserves the right to deliver by instalments.

4. Your Right to Return the Products

4.1 Goods correctly supplied as ordered cannot be returned for credit.
4.2 Faulty items must be notified to the Company within 14 days and confirmation from the Company must be received before items are returned.
4.3 All Goods are supplied with a standard tolerance of 10% for faulty items due to the delicate nature of the goods and shipping requirements to end user. Credits will not be raised for goods or returns accepted below 10% failure rate
4.4 Separate conditions apply where a "Sale or Return" scheme has been agreed for which separate charges may apply.

5. New Accounts

5.1 Until a credit account is established, all orders will be invoiced and the goods despatched on receipt of cheque or other payment.
5.2 The Company reserves the right to delay the despatch of any order until the cheque or other payment has been cleared.
5.3 All applicants for credit trading accounts are requested to supply any information reasonably requested by the Company.

6. Credit and Payment

6.1 Any dispute with an invoice must be notified to the Company within seven days of the invoice date. In the absence of such notification the customer will be deemed to have accepted and approved the invoice.
6.2 Payment terms are strictly 30 days from invoice date for credit accounts unless otherwise confirmed in writing.
6.3 Interest at the rate of 5% above Bank of England base rate will be charged on all amounts outstanding beyond the agreed payment due date and will accrue on a daily basis until date of actual payment.
6.4 Customers may not deduct or withhold payment from any invoice which is not in dispute.
6.5 Payments received will be set against the oldest outstanding invoice if no remittance advice present.
6.6 The Company reserves the right to recover from the customer any costs incurred in connection with an overdue account.
6.7 The Company reserves the right to withdraw credit facilities without notice.

7. Title

7.1 All goods remain property of the Company until paid for in full.
7.2 The Company reserves the right to take possession of goods which have not been paid for, whether or not the customer has entered into liquidation.
7.3 The customer irrevocably authorises the Company in such circumstances to enter the premises where such goods are stored and remove such goods at the customer's expense.
7.4 Notwithstanding the provisions above, risk in all goods supplied shall pass to the customer on delivery whereupon the customer shall be liable for insurance for such goods.

8. Governing Law and Jurisdiction

8.1 The Contract shall be governed by and construed in accordance with English law.
8.2 Both we and you submit to the exclusive jurisdiction of the English courts.

9. Data Protection Information

Any information which you supply, which you have previously supplied or which we may hold about you in the future may be held on our database which will allow us to reflect all the connections that you have with us and support our service to you. The information may also be used for the prevention of fraud and for statistical and research purposes. We will not sell or license your information to any third party. In addition, we may use the information to keep you informed of products and services of other companies in the GLOBAL MARKETING GROUP LIMITED group.
